Cum compromite ACTA mediul academic?

Acreditează ideea că educația e o afacere mai mult decât o valoare de care depinde progresul societății, că afacerile cu bunuri culturale justifică interzicerea răspândirii cunoaşterii şi că valoarea intelectuală a contribuţiilor academice se reduce la preţul lor. Problematica aceasta nu are a face cu comerţul, nu e pentru contabili şi Ministerul Economiei. O repet de câte ori am ocazia: ştiinţa şi arta nu se vând la bucată. Aprecierea lor vine dintr-un exerciţiu intelectual care se transmite cu mari eforturi din generaţie în generaţie. Cineva care nu are nici cea mai vagă idee despre cărţile lui Newton nu dă doi bani pe Einstein. Cineva insensibil la muzică (pentru că n-a avut bani să-şi cultive sensibilitatea artistică) nu are cum să plătească pentru muzică. Bunurile culturale nu au acelaşi regim ca bunurile fizice. Promotorii capitalismului cultural nici măcar nu-şi dau seama că distrug sursa bunurilor pe care doresc să le „protejeze”. Dar nu e vorba numai de bani aici. E vorba de patrimoniul cultural al umanităţii, de felul în care va arăta societatea în viitor. În definitiv, e vorba de supravieţuirea rasei umane.

Care este amploarea filesharingului în zona academică?

Nu pot să emit o estimare. Dar un lucru e cert, în lumea academică schimbul de fişiere este o practică ce datează încă din vremea în care Internet-ul nu fusese deschis pentru comercianţi. Pe Internet, la început a fost ştiinţa. Abia apoi au apărut tarabele zarafilor. World Wide Web a fost creat în scopul distribuirii de fişiere. Tim Berners-Lee a inventat WWW la CERN, în ’90, nu ca să facă comerţ online, ci pentru a rezolva o problemă de comunicare academică, dorind ca fişierele ce conţin informaţii ştiinţifice să fie distribuite eficient. Mulţi cercetători, mai ales în domeniile tehnice, folosesc reţele peer-to-peer pentru a distribui programele de calculator pe care le concep sau date ştiinţifice. Absenţa acestei posibilităţi, lipsa diseminării informației, ar fi un mare pas înapoi. Calitatea activităţilor academice ar scădea foarte mult.

Ce părere aveți de închiderea unor site-uri care diseminau conținut academic precum library.nu?

E cea mai limpede dovadă că ACTA nu este un acord internațional necesar, ci un semn al faptului că un număr de firme foarte bogate urmăresc să modifice modul în care utilizatorii folosesc Internet-ul, împotriva voinţei lor şi împotriva caracteristicilor tehnologiei. După ce PIPA şi SOPA au fost abandonate de Congresul american au urmat acţiuni poliţieneşti de amploare. După protestele împotriva ACTA am anticipat că vor urma altele. Mă aşteptam totuşi ca editurile să aibă o atitudine mai tolerantă faţă de cei ce fac efortul de a citi, dar nu au bani pentru a cumpăra cărţi scumpe. Te aştepţi întotdeauna ca acolo unde sunt cărţi să fie şi oameni înţelepţi. Dar poate că ideea asta e doar o prejudecată inactuală.

Vocile anti-ACTA spun că aceasta urmărește mai degrabă un control al individului sub pretextul drepturilor de autor. Sunteți de acord?

E mai rău decât atât. ACTA urmărește creșterea gradului de control, supraveghere și constrângere în scopul de a expropria o parte din domeniul public. Ideea că interesele investitorilor primează faţă de interesul public este mai dăunătoare decât exercitarea controlului propriu-zis. Dacă banii contează mai mult decât progresul, dacă libertatea se măsoară în sume de bani, dacă negocierile secrete sunt o practică la fel de justificată ca deliberarea democratică, atunci drepturile constituţionale pot fi modificate oricând şi oricum. Iar când tratate precum ACTA ne vor părea înţelegeri internaţionale normale, nimeni nu va mai şti cum este libertatea, chiar dacă ar dori s-o aibă. Să nu ştii ce înseamnă libertatea e mai rău decât să nu o ai.

Drepturile de utilizator restrânse și sancționarea celor care copiază, modifică sau distribuie fără permisiune ajută economia?

Drepturile morale ale autorilor trebuie să fie respectate scrupulos, indiferent de statisticile economice. Dar buna funcţionare a pieţelor culturale depinde de răspândirea informaţiei, nu de ascunderea ei. Concepţia simplistă despre drepturile autorilor devalorizează persoana şi promovează monopolul. E suficient ca filmele tale să se vadă la cinematograf ca să spui că sunt valoroase? Se reduce valoarea unui artist la vânzările înregistrărilor sale? Are sens ca o instituţie publică să achiziţioneze un sistem informatic gata făcut, în loc să foloseascăsoftware liber şi să angajeze programatori, investind întreaga sumă în resursa umană locală? Valorificarea comercială a culturii nu se face cu planul de afaceri de la supermarket.

Este limitarea accesului la informație o formă de regres cultural?

Limitarea drastică a accesului la cunoaștere în numele interesului comercial, interdicția de studia, de a citi, de a aprecia arta, o interdicţie pe care unii încearcă să o impună celor care nu pot să achite un preț stabilit arbitrar, este în mod cert o formă de regres cultural. O bună educaţie nu se dobândeşte cu uşurinţă, fără disciplină şi sacrificii. În condiţiile în care din ce în ce mai puţini dintre noi sunt capabili şi doritori să facă astfel de sacrificii, ce efect vor avea prohibiţiile impuse în numele interesului comercial? Adevărata investiţie în cunoaştere este încurajarea, nu îngrădirea ei. Inteligenţa şi talentul nu depind de venituri.

Există vreo posibilitate legală de a face filesharing cu conținut academic într-o Europă în care se aplică ACTA?

Da. În primul rând, oamenii de ştiinţă şi creatorii de artă autentici păstrează conştiinţa misiunii lor publice. Din acest motiv, ei refuză să apeleze la noile reglementări, distribuind liber propriile lucrări sau înregistrări. Este suficient să vizitezi site-urile marilor universităţi din lume şi vei audia cursuri întregi, vei citi cărţi şi vei admira arta, gratuit, cu „complicitatea” autorilor.

Riot Control Tactics

The tactics used to control riots in the past were simple -- they were based on the fact that the police were almost always better-armed than the rioters. The tactics they used basically consisted of forming a line and charging into the crowd. Today, the police are still well-armed, but tactics have advanced significantly in hopes of preventing injuries.

When a riot is in full swing, police will deploy in a square formation with a command team at the center. The command team is protected on all four sides by echelons of troops deployed in groups of 10 or 12 officers. There is also an arrest team at the center of the square.

This tactical unit is very mobile and able to adapt on the fly to changes in the situation. If a threat suddenly appears behind or to one side of the unit, then the echelon facing that direction is designated the front of the unit. The entire team can then change the direction it's facing without a lot of maneuvering. Also, the echelons can cover each other when the team moves to take advanced positions. If the unit is under attack, the whole team does not move together: One echelon moves while the others provide covering fire or an actual physical screen (with riot shields). Then another echelon moves up into position.

The echelon is not meant to be an impenetrable wall of cop. In fact, the riot squad often leaves an escape route to let rioters run past the squad. The officers can adopt a passive position, in which they spread out and leave several yards between each officer. The crowd can then easily filter through them. If a particularly violent group moves toward the officers or they spot specific suspects they want to arrest, they can quickly close the gaps and form a tight line.

As the unit moves forward into a crowd, it will prod and push at anyone who doesn't respond to requests to move away by the time the front echelon reaches them. If they still refuse to move, the unit continues moving forward, but the front echelon opens up and passes around the protestors. Once the protestors are inside the square, the unit stops, the front echelon reforms and the arrest team processes the rioters. When they're done, the unit can continue moving.

Crowd-control Philosophy: Conflict

If a crowd gets unruly and starts taking violent action, then the police will switch to a more aggressive attitude. Their actions here reflect the fact that almost all riots are incited and lead by a few individuals who feel strongly or have something to gain from a violent confrontation. The majority of the people present either show up because something exciting is going on or are bystanders who got carried into the mob mentality. Faced with the possibility of arrest or confrontation with police, most of them simply want to escape and go home.

The first step is simple intimidation. Riot officers stand in strict formations and act with military precision. Once they form echelons -- lines of officers that effectively work as barriers -- the officers tap their batons on their shields or stomp their feet in unison. The result can be quite frightening to unarmed civilians -- it looks and sounds as if this group of armed and armored officers is getting ready to come crashing down with clubs swinging. In truth, this display is meant to scare off as many of the rioters as possible without the officers ever getting near them.

Police do not try to arrest every rioter. Their first targets are those who are leading the riot, because often the crowd will disperse without their leaders firing them up and encouraging them. All people who are spotted breaking a law are also targeted for arrest, especially if they injure or kill another person.

When it gets to the point where officers are actually in conflict with the rioters, the goal is still to disperse the crowd. A combination of advancing lines of officers and the use of noxious gas is used to direct the crowd in a certain direction or keep them away from a certain area. The crowd is never pinned down -- rioters are always given an escape route, since the whole point is to get them to run away.

Tribler

While the file-sharing ecosystem is currently filled with uncertainty and doubt, researchers at Delft University of Technology continue to work on their decentralized BitTorrent network. Their Tribler client doesn’t require torrent sites to find or download content, as it is based on pure peer-to-peer communication. “The only way to take it down is to take the Internet down,” the lead researcher says.

The Tribler BitTorrent client is no newcomer to the BitTorrent scene. It has been in development for more than 5 years and has delivered many innovative features, which have mostly been ignored by the masses.
Today, however, Tribler is more relevant than ever before.

Developed by a team of researchers at Delft University of Technology, the main goal is to come up with a robust implementation of BitTorrent that doesn’t rely on central servers. Instead, Tribler is designed to keep BitTorrent alive, even when all torrent search engines, indexes and trackers are pulled offline.

“Our key scientific quest is facilitating unbounded information sharing,” Tribler leader Dr. Pouwelse tells TorrentFreak.


According to Dr. Pouwelse, Tribler is fully capable of resisting any pressure from outside, and it will still work when all torrent sites and trackers are gone. It simply can’t be shutdown, blocked or censored, whatever laws politicians may come up with.
“The only way to take it down is to take The Internet down.” Pouwelse told us.


While the Tribler client only has a few thousand users at the moment, for avid file-sharers it must be a relief to know that it’s out there. No matter what crazy laws may pass in the future, people will always be able to share.

Ba poţi! Ştiţi cum aş face? Să zicem că suntem la Ministerul de Interne - îi dau o sugestie domnului Blaga, deşi ştiu că nu o să mă asculte -, intru şi mă uit care este cel mai mic în grad. „Tu ce eşti?", „Sublocotenent, să trăiţi!", „Din clipa asta tu eşti şeful! Vii peste o lună şi îmi spui ce măsuri ai luat." Cu entuziasmul tinereţii - pentru că numai atunci funcţionează asta, până n-ai învăţat că sistemul merge - va lua hotărâri. Foarte mulţi tineri nu ştiu că „sistemul" merge şi nu sunt resemnaţi. Ei cred că acesta poate fi oprit, şi atunci chiar poate fi oprit. În 1900, Academia Franţei a decretat că un obiect mai greu decât aerul nu poate zbura. Logic şi ştiinţific, au dreptate. Iată însă că există o portiţă de scăpare prin care dorinţa a fost mai puternică decât logica şi de cât ştiinţa. Dacă voi combina portanţa cu viteza vântului şi cu motorul, voi putea să zbor.

E valabilă analogia cu ceea ce se întâmplă la nivel instituţional în România...

Sigur că da! E suficient să nu ştii că nu se poate, ca să se poată şi în România.

    The way we were




    When Florida Attorney Norm Kent received a form letter from Sen. Norm Coleman condemning marijuana, Kent fired off this note to his former Hofstra University smoking buddy.
    My friend Norman,
    Years ago, in a lifetime far away, you did not oppose the legalization of marijuana...
    Sure, we had to tape the doors shut, burn incense and open the windows...yet we grew up okay, without the help of the Office of National Drug Control Policy's advice.
    We grew up to become lawyers. Our other friends, as you go down the list, are doctors, professors, parents, political consultants and professionals. No one ever got cancer from smoking pot or diabetes from using a joint.
    You never said then that pot was dangerous. What was scary then, and is as frightening now, is when national leaders become voices of hypocrisy, harbingers of the status quo, and protect their own position instead of the public good.
    In your public life, as an attorney general, mayor and United States senator, you have been in the forefront of speaking out against abuses which are harmful. You have been a noble and honorable public servant... How about admitting that if the Rockefeller drug laws were applied to Norman Bruce Coleman on Long Island in 1968, or to me, or to our friends, and fellow students, you, I and others we knew and loved might just be getting out of jail now?
    How about standing up and saying: "I, Norm Coleman, smoked pot in 1969." That "I am not a gang member, a drug addict or a criminal." How about saying: "I was able to responsibly integrate my prior pot use into my life, and still succeed on my own merits."
    How about standing up not only for who you are, but who you were?
    Norm Kent
